INTERPRETĂRI ȘI DEOSEBIRI PRACTICE ÎNTRE CEREREA DE ACCES LA INFORMAŢIA OFICIALĂ ȘI PETIŢIE

Abstract

Prezentul articol îşi propune drept scop ilustrarea diferenţelor între noţiunea juridică de petiţie şi cererea de acces la informaţiile oficiale. Articolul subliniază faptul că solicitarea de acces la informaţiile oficiale nu poate şi nu trebuie interpretată în exclusivitate în baza prevederilor Codului administrativ al Republicii Moldova, or, această practică, în cazul în care are loc, este una frauduloasă şi poate genera un val de nemul ţumiri cetăţeneşti, manifestate prin proceduri judiciare în contencios administrativ, iniţiate împotriva autorităţilor publice, drept forme de protecţie a dreptului de acces la informaţie.

The purpose of this article is to illustrate the differences between the petition and the request for access to official information. The article stresses that the request for access to official information cannot and should not be interpreted exclusively on the basis of the provisions of the Administrative Code of the Republic of Moldova, or this practice where it takes place is a fraudulent one and can generate a wave of citizen dissatisfaction manifested by judicial procedures in administrative litigation initiated against public authorities, as forms of protection of the right of access to information.
