Tendinţele şi perspectivele controlului activităţii notariale de către organele competente [Articol]

Abstract

This article is going to reflect the main ideas of the notaries’ activity control by the judiciary bodies, prosecutor bodies, tax bodies and the court. There will be given classifications of the control, it will be researched in a comparative method the legislation and the judiciary doctrine of the notaries’ institution control. There will be discussed the normative provisions that do not have practical applicability and comparative studies with the legislation of other states. There are going to be discussed not just the practices existed in the Republic of Moldova but also will be researched in details the legislative gaps of other states with subsequently proposals.

Данная статья отражает ключевые области контроля нотариальной деятельности фискальными органами, органами юстиции, прокуратуры и судом. Статья содержит классификацию контрольной деятельности, сравнительный анализ контроля данной деятельности в рамках законодательства и юридической доктрины. Приводятся нормативные положения, которые не имеют практического применения и сравнения с законодательством других стран. В процессе анализа выявлены колизии и лакуны, существующие в действующем законодательстве других стран с последующими предложениями, а также иследуется практика нотариальной деятельности Республики Молдова.
