REGLEMENTAREA ÎN UNIUNEA EUROPEANĂ A PROCEDURII CU PRIVIRE LA ÎNCASAREA CREANȚELOR PECUNIARE NECONTESTATE

Abstract

In this article the author analyses the European Union legal framework which serves as basis for the courts to order collection of undisputed pecuniary claims. The author highlights that the simplification of the existent judicial procedures represents one of the main objectives of administration of justice, according to which the courts shall have the right to rule in a faster and less formal way on claims undisputed by the debtor. In this way, the creditors shall be granted an efficient, rapid, and fair procedural tool to obtain satisfaction of their claims in cases which, due to lack of dispute and actual recognition of the submitted claim by the debtor, would be rational and time wise not to pass through all the stages of a formal classical judicial process. The used research methods include: the analysis of the provisions of the European Union legal framework and synthesis of the domain-related existing judicial practice.
