Abstract
Frontiera unui stat și imposibilitatea extrădării persoanei care a comis o infracțiune nu trebuie să constituie impedimente pentru aplicarea răspunderii penale și, respectiv, pentru restabilirea echității. Conștientizând acest lucru, recunoașterea și executarea hotărârilor penale străine a fost reglementată ca una dintre formele de cooperare internațională în materie penală. Esența acestei forme de cooperare internațională rezidă în faptul că unei hotărâri pronunțate într-un alt stat i se dă efect pe teritoriul unui alt stat, de regulă, acolo unde se află persoana condamnată. În cadrul acestui studiu s-a pus accentul pe cadrul normativ în materie, pe practica judiciară și pe doctrina referitoare la recunoașterea și executarea hotărârilor penale străine. Sunt stabilite condițiile de formă și condițiile de fond referitoare la recunoașterea hotărârilor penale străine. De asemenea, autorii polemizează pe marginea procedurii de recunoaștere a hotărârilor penale străine. În fine, sunt formulate o serie de recomandări.
The border of a state and the impossibility of extraditing the person who has committed a crime should not constitute impediments to the application of criminal liability and, respectively, to the restoration of equity. Recognizing this, the recognition and enforcement of foreign criminal judgments has been regulated as one of the forms of international cooperation in criminal matters. The essence of this form of international cooperation lies in the fact that a judgment pronounced in another state is given effect on the territory of another state, as a rule, where the convicted person is located. In the framework of this study, acceptance was placed on the normative framework in the matter, on the judicial practice and on the doctrine regarding the recognition and execution of foreign criminal judgments. The formal conditions and the substantive conditions regarding the recognition of foreign criminal judgments have been established. The procedure for the recognition of foreign criminal judgments has also been debated on. Finally, a series of recommendations have been formulated.
