UNELE CONSIDERENTE CU PRIVIRE LA PROBLEMA BĂNUIELII REZONABILE ÎN MATERIA ARESTĂRII PREVENTIVE

Abstract

În acest articol va fi abordată problema privind prezența suspiciunii rezonabile ca o condiție care admite ingerințe în dreptul la libertatea și siguranța persoanei, protejat de art.5 din Convenția Europeană a Drepturilor Omului. În acest context se va examina problematica constatată de Curtea Europeană a Drepturilor Omului în materia suspiciunii rezonabile și situația actuală în practicile din Republica Moldova.This article examines the issue of the presence of a reasonable suspicion as a condition that admits the interference with the persons' right to liberty and security, protected by Article 5 of the European Convention on Human Rights. In this context, the issue identified by the European Court of Human Rights on the matter of reasonable suspicion and the current situation in the practices of the Republic of Moldova will be examined.
