Aspecte conflictuale privind partajul şi transmiterea averii succesorale

Abstract

Share and ceding of the succession are governed by the substantive law determined by the conflict rule under the statute of the goods which form the inheritance, in case of movable property, by the national law of the deceased at the time of death and in case of immovable property according to the law of location of goods, but as an exception, other conflicting rules can be applied in achieving both areas as the acts of acceptance or refusal, inheritance capacity, procedural forms, etc.
