LATURA OBIECTIVĂ A INFRACŢIUNII DE ÎMBOGĂŢIRE ILICITĂ

Abstract

Infracţiunea de îmbogăţire ilicită a fost, este şi nu-şi va pierde actualitatea în contextul dezvoltării relaţiilor sociale, economice şi politice. Dat fiind faptului că în componenţa acestei infracţiuni regăsim un element specific, ce se referă la modalitatea de săvârşire a infracţiunii de către o persoană cu funcţie de răspundere sau de către o persoană publică, considerăm că este imperios de necesar să relatăm despre acest fapt şi să venim cu precizări, precum şi să stabilim factorii care au stat la baza formării acestui element fără de care nu este posibilă incriminarea infracţiunii. Susţinem ideea precum că acest aspect trebuie discutat în contextul numeroaselor cauze penale care au stat la baza acestui articol şi care, adesea, provoacă dificultăţi organului de urmărire penală.

The crime of illicit enrichment was, is and will not lose its relevance in the context of the development of social, economic and political relations. Given the fact that in the composition of this crime we find a specific element, which refers to the manner of committing the crime by a person with a position of responsibility or by a public person, we consider it imperative to report on this fact and to we come with clarifications, as well as to establish the factors that formed the basis of the formation of this element without which it is not possible to incriminate the crime. We support the idea that this aspect should be discussed in the context of the numerous criminal cases initiated on the basis of this article, and which often cause difficulties for the criminal investigation body.
