LEGALITATE ȘI LEGITIMITATE – PRINCIPII DE BAZĂ APLICATE ÎN REGLEMENTAREA ORGANIZĂRII ȘI FUNCȚIONĂRII SISTEMULUI JUDECĂTORESC

Abstract

Statul de drept și democrația se prezumă că sunt întemeiate pe principiul preeminenței dreptului. În aceste circumstanțe, actul normativ, pentru a fi izvor de drept aplicabil cu consecințe legitime, trebuie să fie adoptat conform literei și spiritului procedurii prestabilite. Aceasta impune legitimitatea actului normativ și declară autenticitatea organului emitent. În articolul de față vom supune analizei teoretico-juridice legitimitatea legii privind răspunderea disciplinară a judecătorilor, adoptată prin angajarea răspunderii Guvernului.

The state of law and democracy are presumed to be based on the rule of law. In these circumstances, the normative act, in order to be a source of applicable law with legitimate consequences, must be adopted according to the letter and spirit of the pre-established procedure. It imposes the legitimacy of the normative act and declares the authenticity of the issuing body. In this article, we will submit to the theoretical-legal analysis in terms of the legitimacy of the law on sanctioning judges, adopted by engaging the responsibility of the Government.
