SISTEMUL INFORMATIC ȘI REȚEAUA INFORMATICĂ: OBIECTE MATERIALE ALE INFRACȚIUNILOR PREVĂZUTE LA art.259 DIN CODUL PENAL

Abstract

Obiectul material secundar al faptelor incriminate la art.259 din Codul penal al Republicii Moldova îl formează, între altele, sistemul informatic sau reţeaua informatică. În prezentul studiu este efectuată analiza noțiunilor „sistem informatic” și „rețea informatică”. În acest scop sunt examinate definițiile normative și doctrinare ale acestor noțiuni. Este criticată definiția dată noțiunii „sistem informatic” la lit.a) art.2 al Directivei 2013/40/UE. Este stabilită relația dintre noțiunile „sistem informatic” și „sistem informațional”, precum și relația dintre noțiunile „sistem informatic” și „rețea informatică”. Sunt relevate împrejurările în care devine posibil concursul ideal al infracțiunilor prevăzute la art.259 și 2611 din Codul penal al Republicii Moldova. Nu în ultimul rând, este propusă completarea Codului penal al Republicii Moldova cu articole în care ar fi definite noțiunile „sistem informatic” și „reţea informatică”.

The secondary material object of the offenses, provided in art.259 of the Criminal Code of the Republic of Moldova, is represented, among others, by the computer system or by the computer network. In the present study, the notions of “computer system” and “computer network” are analyzed. For this purpose, the normative and doctrinal definitions of the notions in question are examined. The definition of the notion “computer system” from the let.a) art.2 of Directive 2013/40/EU is criticized. The relationship between the concepts of “computer system” and “information system” is established. The relationship between the concepts of “computer system” and “computer network” is also established. The circumstances in which the ideal cumulation of the offenses provided in art.259 and 2611 of the Criminal Code of the Republic of Moldova becomes possible are revealed. Last but not least, it is proposed to complete the Criminal Code of the Republic of Moldova with articles that would define the notions “computer system” and “computer network”.
