CONFLICTUL ÎN TIMP AL LEGII PENALE DE DEZINCRIMINARE (ABOLITIO CRIMINIS)

Abstract
În cadrul acestui articol a fost analizată legea penală de dezincirimnare. Codul penal al Republicii Moldova nu utilizează
expresia „lege favorabilă”. Natura acestei legi se deduce din formularea legislativă inserată în alin.(1) art.10 CP RM.
Autorii menționează că legea nu prevede expres criteriile după care va fi determinată legea penală mai favorabilă; totodată,
vor fi avute în vedere: condițiile de incriminare a faptei; condițiile de tragere la răspundere; condițiile de sancționare;
consecințele condamnării. În cadrul cercetării s-a arătat că legea penală de dezincriminare (lat. – Abolitio criminis) este
o varietate a legii penale care înlătură caracterul penal al faptei. Însă, este o noțiune mai restrânsă, fiind cu legea penală
în coraport de „parte-întreg”. Orice lege de dezincriminare este legea care înlătură caracterul penal al faptei, însă nu orice
lege care înlătură caracterul infracțional al faptei devine lege de dezincriminare, cum ar fi în cazul introducerii unor norme
juridico-penale în Partea generală a Codului penal.
In the realm of this article the criminal law of desincrimination has been analyzed. Criminal code of the Republic of Moldova doesn’t use the expression of “favorable law”. Nature of this law is deduced from the legislative expression inserted in paragraph (1) article 10 from the Criminal code of the Republic of Moldova. Authors demonstrated that the law doesn’t provide in an express manner the criteria in function of which a favorable law could be determined: conditions concerning incrimination; conditions of criminal liability; conditions of sanctioning; consequences of conviction. In the limits of this investigation, there have been demonstrated that the law of desincrimination (lat. – Abolition criminis) is a type of the criminal law which eliminates the criminal character of the act. More than that, this term is narrower being in a correlation of ‘the whole and the part’. Any law of desincrimination is considered to be a law which eliminates the criminal character of the act, but not any law which eliminates the criminal character of the law becomes law of desincrimination, as it happens in case of introduction of favorable law in the General part of the Criminal code.
