PREZENTAREA ISTORICĂ A IRESPONSABILITĂŢII ÎN SISTEMUL COMMON LAW

Abstract

Scopul acestui articol constă în identificarea şi examinarea detaliată a evoluţiei istorice a iresponsabilităţii în sistemul common law. Pentru atingerea scopului nominalizat a fost efectuată analiza normelor legislative, precum şi a standardelor şi a testelor aplicabile pe parcursul istoriei la depistarea şi evaluarea stării de incapacitate psihică la făptuitor. În rezultatul investigaţiei sunt formulate unele concluzii apte de a fi luate în considerare şi în doctrina contemporană cu privire la instituţia iresponsabilităţii.The purpose of the present article consists in the identifying as well as in the detailed explanation of the historical evolution of irresponsibility in the common law system. In order to obtain the named purpose there was effectuated the rigorous analysis of the legislative norms, as well as of the standards and tests applied during the history at the identifica- tion and evaluation of the mental incapacity of the defendant. As a result, there were formulated some conclusions which are seemed viable for the further implementation in our penal doctrine concerning the institution of irresponsibility.
