Îndatoririle fundamentale – veritabile obligaţii juridico-morale constituţionale: abordări teoretice şi reglementări

Abstract

Fiinţa umană în virtutea naşterii dobândeşte un şir de drepturi şi libertăţi, recunoscute fundamentale şi naturale după natura juridică. În acelaşi timp, orice persoană are şi îndatoriri faţă de colectivitate, deoarece numai în cadrul acesteia este posibilă dezvoltarea liberă şi deplină a personalităţii sale. Totodată, îndatoririle fundamentale mobilizează oamenii la realizarea scopurilor societăţii constituind în acelaşi timp garanţia, printre alte garanţii, că drepturile fundamentale se pot realiza efectiv.

The human being in the virtue of the birth gets a number of recognized fundamental and natural rights and liberties, and natural as to their juridical nature. At the same time, any person also has obligations to collectivity, because only in its framework it is possible the free and complete development of his personality. At the same time, the fundamental obligations mobilize people to carry out the society’s goals and at the same time constituting the guarantee among other guarantees, that his fundamental rights can effectively come true.
