CONSIMŢĂMÂNTUL VICTIMEI ÎN CADRUL INFRACŢIUNILOR PRIVIND VIAŢA SEXUALĂ

Abstract

The right to liberty is one of the most fundamental human rights. Sexual autonomy, that means someone’s prerogative to determine when, with whom, and under what circumstances they engage in sexual activity, is one of the basic components of the general right to liberty. The problem of the victim’s consent in sexual offenses is extremely actual. The novelty of the investigated topic and the obtained results lies in the innovative character of the approach of the victim’s consent within the crimes against the sexual inviolability and sexual freedom of the person. By explaining and interpreting the notions of criminal law, the study has the aim to try to contribute to the standardization of judicial practice and to be a useful working tool for practicians, and the conclusions and proposals can be taken into account to improve judicial practice in this field.
