CU PRIVIRE LA HOTARAREA JUDECATOREASCA CONTRAVENȚIONALA: PROBLEME ȘI SOLUȚII

Abstract

The dimension oflaw issues in the area of contraventions, mainly consisting in establishment and development of law on contravention in the legislative system ofthe Republic of Moldova, prefigures the fundamental restructuring of the national jurisprudence, legal science and process of education in law, so that this article brings up the issue for practical and scientific discussion that is important and urgent for jurisprudence aimed at the court ruling pronounced for the contraventional cause. In the context of examined issues and guided by the statement of the ancient philosopher Aristotle: “The judge is the law that lives”, we suggest a new conception concerning court ruling on an contraventional case and revealing some aspects of normative, jurisprudential, educational and legal nature, we draw conclusions based on the interdependence between theoretical and practical knowledge, that is on the way of legislative, doctrine and jurisprudential development.
