VIAȚA PRIVATĂ ȘI DREPTUL LA UN MEDIU SĂNĂTOS

Abstract

În trecut, puţin relevantă şi controversată, calitatea mediului a devenit un aspect foarte important al drepturilor omului şi, în prezent, din ce în ce mai mult un drept fundamental cu statut propriu şi independent. Fiind un drept de ultimă generaţie, dreptul la un mediu sănătos şi echilibrat ecologic s-a dovedit a fi cel mai rapid în evoluţie din generaţia sa, în ceea ce priveşte garantarea şi efectivitatea lui pe calea justiţiei. În acest sens, se poate observa şi constituţionalizarea lui la nivelul statelor în numai câteva decenii, favorizând dezvoltări corespunzătoare în plan regional şi internaţional. În acelaşi timp, apariţia problemel or ecologice globale (efectul de seră, schimbările climatice, diminuarea stratului de zon etc.) a contribuit la consolidarea statutului său de drept fundamental şi de drept la supravieţuire al omenirii.

In the past, a little relevant and controversial, the quality of the environment became a very important aspect of human rights and now it is an increasingly fundamental right with its own and independent status. As the last generation of law, the right to a healthy and ecologically balanced environment has proven to be the fastest-growing population of its generation in terms of its guarantee and effectiveness on the road of justice. In this regard, its constitutionalization at the State level can be seen in only a few decades, favoring appropriate regional and international development. At the same time, the emergence of global environmental problems (the greenhouse effect, climate change, ozone depletion, etc.) has helped to strengthen its fundamental and legal right to humanity`s survival
