VICTIMA OMORULUI SĂVÂRȘIT ÎN STARE DE AFECT

Abstract

Nu orice infracţiune presupune prezenţa victimei. Infracţiunea prevăzută de art. 146 din Codul penal al Republicii Moldova face parte din categoria de infracţiuni care presupun prezenţa victimei. Se are în vedere persoana care provoacă starea de afect a făptuitorului prin acte ilegale sau imorale. Victima infracţiunii prevăzută la art. 146 din Codul penal este un semn ce caracterizează obiectul acestei infracţiuni. Anume conţinutul valorii și relaţiilor sociale apărate contra infracţiunii prevăzută la art. 146 din Codul penal face ca vinovăţia victimei să reducă parţial vinovăţia făptuitorului.Not every crime involves the presence of the victim. The crime, provided by art. 146 of the Criminal Code of the Republic of Moldova, is a part of the category of crimes involving the presence of the victim. Namely the content of the value and social relations, defended against the crime provided by art. 146 of the Criminal Code of the Republic of Moldova, make the guilt of the victim to partially reduce the guilt of the perpetrator.
