О ПРЕДМЕТЕ ПРЕСТУПЛЕНИЙ, ПРЕДУСМОТРЕННЫХ СТ. 290, СТ. 291, СТ. 292 УК РМ: УГОЛОВНО-ПРАВОВОЙ АНАЛИЗ, ВЫВОДЫ И РЕКОМЕНДАЦИИ

Abstract

This scientific article is devoted to the criminal law analysis of firearms, their components, explosive devices and explosives from the point of view of their consideration as material objects of crimes committed in the field of their illicit trafficking (Art. 290, Art. 291, Art. 292 of the Criminal Code of the Republic of Moldova) . It has been proven that the main parts of firearms fall out of the legislator’s field of vision, and the structure of Articles 290 and 292 of the Criminal Code of the Republic of Moldova should be revised in terms of systematizing the material objects of crimes. In modern conditions, illicit trafficking in weapons, their components, explosive devices and explosives is an international crime, and, obeying the principle of universality in criminal law, the states parties to international conventions in the designated area are obliged to prosecute and punish all persons (organizers, instigators, authors and accomplices) at all stages (preparation, attempt, completed crime) of the commission of any crime in the sphere of illegal circulation of these items. In turn, we analyzed the legislative experience of some countries of the Anglo-Saxon system of law (USA and India) in order to clarify and identify the features of the criminalization of illicit trafficking in weapons, their components, explosive devices and explosives in these states.

Acest articol științific este consacrat analizei juridico-penale a armelor de foc, a componentelor acestora, a dispozitivelor explozive și a substanțelor explozive din punctul de vedere al recunoașterii acestora în calitate de obiect material al infracțiunilor săvârșite în domeniul traficului ilicit al acestora (art. 290, art. 291, art.292 din Codul penal al Republicii Moldova). S-a demonstrat că părțile principale ale armelor de foc nu se încadrează în câmpul vizual al legiuitorului, iar structura articolelor 290 și 292 din Codul penal al Republicii Moldova ar trebui revizuită în ceea ce privește sistematizarea subiecților infracțiunilor. În condițiile contemporane, traficul ilicit de arme, componente ale acestora, dispozitive explozive și substațe explozive constituie o infracțiune cu caracter internațional, iar, respectând principiul universalității în dreptul penal, statele părți la convențiile internaționale din zona desemnată sunt obligate să urmărească și să pedepsească toate persoanele (organizatori, instigatori, făptuitori și complici) în toate etapele (pregătirea, tentativa, infracțiunea finalizată) ale săvârșirii oricărei infracțiuni din sfera circulației ilegale a acestor bunuri. Cu toate acestea, am analizat experiența legislativă a unor țări din sistemul de drept anglo-saxon (SUA și India) pentru a clarifica și identifica trăsăturile incriminarii traficului ilicit de arme, componente ale acestora, dispozitive explozive și explozivi în aceste state.
