Constatarea tehnico-științifică a specialistului-criminalist – formă de aplicare a cunoștințelor specializate în procesul penal

Abstract

The present work deals with the problems referring to the research activities carried out by the forensic specialist in the penal process, especially the technical-scientific reports, the difference between these reports and the judicial expertise – both of them being forms of application of specialized knowledge in the penal process. Arguments are brought in favour of the idea that unlike the expert, the specialist is the one, who by law, gives assistance to the criminal investigation authority or the court more than contributes to actually providing evidence. Suggestions de lege ferenda are made regarding modifying and completing art. 87 and art. 141 of the Penal Procedure Code of the Republic of Moldova.
