OBIECTUL JURIDIC AL INFRACȚIUNII PREVĂZUTE LA art.3302 „ÎMBOGĂȚIREA ILICITĂ” DIN CODUL PENAL

Abstract

Orice infracţiune săvârșită aduce atingere unui anumit obiect juridic, aceasta îi cauzează o anumită daună în cazul infracțiunilor materiale ori îl pune în pericolul cauzării unei asemenea daune în cazul infracțiunilor formale. Conceptul de obiect al infracțiunii este central în teoria dreptului penal. Astfel, pentru a determina conținutul acestui concept în doctrina modernă a dreptului penal, prin această lucrare ne punem sarcina de a identifica esența obiectului „îmbogățirii ilicite” ca fenomen social și juridic, de a distinge conceptul acestuia de alte infracțiuni. La fel atragem atenția asupra conceptelor inegale de obiect al infracțiunii săvârșite și obiect în componența infracțiunii. Fără o definire corectă a obiectului infracțiunii, este imposibil a determina esența juridică a acestuia și a stabili limitele răspunderii penale.

Any crime committed affects a certain legal object, it causes a certain damage in the case of material crimes or puts it in danger of causing such damage in the case of formal crimes. The concept of the object of the crime is central in the theory of criminal law, so, in order to determine the content of this concept in the modern doctrine of criminal law, through this work, we set ourselves the task of identifying the essence of the object of the crime as a social and legal phenomenon, to distinguish the concept from other crimes. In the same way, we draw attention to the unequal concepts of the object of the crime committed and the object in the composition of the crime. Without a correct definition of the object of the crime, it is impossible to determine the legal essence and establish the limits of criminal liability.
