Abstract
Mecanismele contenciosului internaţional al drepturilor omului sunt frecvent reclamate de către justiţiabilii europeni în faţa unei jurisdicţii internaţionale în obiectivul cărora intră protecţia drepturilor şi libertăţilor fundamentale ale omului. Iar actele jurisdicţionale internaţionale emise de către aceste instanţe deja produc efecte nu doar asupra statelor, dar şi asupra persoanelor fizice, şi nu reprezintă un enunţ abstract, odată ce afectează viaţa indivizilor concreţi. Curtea Europeană a Drepturilor Omului emite hotărâri la cererea indivizilor, hotărâri care, pe de o parte, restabilesc şi/sau repară drepturile încălcate de autorităţile statale, iar pe de altă parte - indică statelor carenţele dreptului lor intern şi, în consecinţă, trebuie să fie executate în ordinea juridică internă, necondiţionat, hotărâri care fac, de asemenea, parte din categoria actelor jurisdicţionale internaţionale.
Mechanisms of the international contentious law are frequently claimed by the European litigants in front of the in-ternational jurisdictions which activity vises the protection of fundamental rights and freedoms. The judicial acts rendered by such jurisdictions have effects not only upon the states, but also upon the individuals, representing not an abstract state-ment if affect the life of certain persons. The European Court of Human Rights adopts judgments based on individual applications, which reestablish and repair the rights violated by state authorities and indicates to the states the lacks of the national legal systems. These judgments, part of generic category of international judicial acts, should be executed unconditionally in internal legal order of the concerned states.
