Regimul juridic general al termenelor de decădere [Articol]

Abstract

Articolul este dedicat analizei termenului de decădere în dreptul civil al Republicii Moldova, evidențiind rolul său ca mecanism strict și imperativ care conduce la stingerea definitivă a dreptului subiectiv civil neexercitat în termen, protejând stabilitatea, previzibilitatea și ordinea raporturilor juridice, precum și siguranța părților implicate în raporturile civile. Sunt prezentate funcțiile, clasificările, natura juridică și regimul juridic al termenelor de decădere, incluzând criteriile de stabilire, izvorul, obiectul și domeniul de aplicare al acestora, precum și diferențele esențiale față de termenele de prescripție extinctivă, subliniindu-se importanța lor în disciplinarea exercitării drepturilor, prevenirea incertitudinii și protecția intereselor părților vulnerabile în diverse situații juridice.

The article is dedicated to the analysis of forfeiture periods in civil law of the Republic of Moldova, highlighting their role as a strict and mandatory mechanism that leads to the definitive extinction of an unexercised subjective civil right, safeguarding the stability, predictability, and order of legal relations, as well as the security of the parties involved in civil relationships. It presents the functions, classifications, legal nature and legal regime of forfeiture periods, including the criteria for their establishment, their source, object and sphere of application, as well as the essential distinctions from extinctive prescription, emphasizing their importance in regulating the exercise of rights, preventing legal uncertainty, and protecting the interests of vulnerable parties in various legal contexts.
