INTEGRITATEA CA ELEMENT AL CAPACITĂȚII JURIDICE A MAGISTRATULUI

Abstract

Integritatea repezintă un element esențial al capacității juridice a magistratului și, ca și consecință, criteriul ce determină nivelul de încrede a societății în justiția națională. Este imposibilă manifestarea integrității magistratului, dacă nu este promovat și consolidat sistemul de garanții sociale, acel câmp psihologic de legalitate chemat să influențeze psihologic magistrații, dar și garanția integrității – toate fiind asigurate de stat. Integritatea este un criteriu obligatoriu atât la formarea inițială, cât și la formarea continuă a magistratului.Integrity is an essential element of the magistrate's legal capacity and, as a consequence, the criterion that determines the level of trust of society in national justice. It is impossible to manifest the integrity of the magistrate if the system of social guarantees is not promoted and consolidated, i. e. that psychological field of legality called to psychologically influence the magistrates, but also the guarantee of integrity  all being provided by the state. Integrity is a mandatory criterion for both the initial training and the continuing training of the magistrate.
