RESPECTAREA FORȚEI OBLIGATORII A HOTĂRÂRILOR CURȚII EUROPENE A DREPTURILOR OMULUI

Abstract

Forța obligatorie a hotărârilor pronunțate de Curtea de la Strasbourg reprezintă un „pilon” major pe care se sprijină sistemul instituit de Convenția pentru apărarea drepturilor omului și a libertăților fundamentale. În timp ce uneori nu se ține cont de caracterul obligatoriu al hotărârilor Curții, reiterat la diverse ocazii de către organismele internaționale, există anumite instrumente îndreptate spre revitalizarea procesului de executare a hotărârilor de „condamnare” neglijate.

The binding force of the judgments issued by the Strasbourg Court is a major “pillar” that the system established by the Convention for the Protection of Human Rights and Fundamental Freedoms rests upon. While the binding nature of the Court's judgments, reiterated by international bodies on various occasions is sometimes not taken into account, there are certain instruments aimed at revitalising the process of executing the neglected judgments of “conviction”.
