STUDIU COMPARAT AL DREPTULUI DE REVOCARE A CONTRACTELOR LA DISTANȚĂ

Abstract

În acest studiu va fi abordat dreptul de revocare a contractelor la distanță și a contractelor încheiate în afara spațiilor comerciale, drept care conferă posibilitatea încetării contractelor încheiate de subiecți în raporturile juridice civile la distanță (în format online), raporturi stabilite de către profesioniști și de consumatori. Vor fi cercetate avantajele dreptului de revocare și dezavantajele atât pentru vânzători, cât și pentru consumatori, în atenție fiind luate termenul de înaintare a dreptului de revocare, precum și efectele dreptului de revocare. Va fi pusă în discuție practica judiciară a Curții Europene, a instanțelor naționale, fiind cercetate chestiunile litigioase precum despăgubirile și cazurile în care este atribuit dreptul profesionistului de a le încasa, limitele și disputele ce apar între directivele europene și prevederile legislațiilor interne ale statelor membre, în comparație cu prevederile legislative existente pe teritoriul național. De asemenea, vor fi abordate termenele de prescripție și alte aspecte relevante. În final, vor fi formulate concluzii și recomandări vizavi de subiectul dreptului de revocare.This study researches the right of withdrawal from distance contracts, and contracts which gives the possibility of termination of contracts signed by subjects in distant relations (online format) by consumers. It discusses the advantages and disadvantages for both sellers and consumers, the time-limit of the right of withdrawal, the effects of the exercise of the right of withdrawal. The case-law of the Judicial Court of the EU will be called into question, with national courts investigating disputes such as compensation and cases in which a business is entitled to a claim, the limits and disputes that arise between European directives and the laws of the Member States, the existing legislative provisions on the national territory. Furthermore, the article covers the prescription period and other related aspects. Finally, we make conclusions and recomendations with regard to the right of withdrawal.
