Abstract

Discretionary termination of criminal proceedings by the prosecutor may be ordered on certain grounds provided by the Articles 54, 55, 56, 57, 58, 59 of the Criminal Code, applying the institution of release from criminal liability. The order for discretionary termination must be based on all the cumulative conditions, provided by criminal and procedural law, with a justified conclusion edified on multiple circumstances favorable for defendant, which sounds like: ,,correction of the person is possible without being subject to criminal liability". Educational measures of restraint, determined by the prosecutor against a minor, are executed by the probation counselor. The fine shall be paid in full within 30 days after the entry into force of the order for the termination of criminal proceedings.
