CONCEPTUALIZAREA DREPTULUI CONTRACTELOR COMERCIALE

Abstract

Anume în urma cercetării evoluției contractelor comerciale prin prisma perioadelor istorice ale sale, putem afirma cert că atât dreptul civil, cât și dreptul comercial (dreptul afacerilor – în accepțiunea modernă) au transmis, puțin câte puțin, contractelor comerciale un caracter de instituție juridică individuală, cu un aspect vădit autonom în cadrul dreptului privat, acordându-i-se o nișă separată atât în reglementări, cât și în utilizări practice de zi cu zi, fapte ce pot fi probate nemijlocit prin doctrină și prin opera legislativă existentă.

Namely as a result of the research of development of commercial contracts through the historical periods of them, we can say definitely that civil law as well as commercial (business law – in the modern sense) transmitted, little by little, to commercial contracts a character of the institutional legal entity, with an aspect manifestly autonomous under private law granting them into a separate niche both in legislation and in practical everyday uses, facts that can be proved directly by doctrine and existing legislative work.
