Corelaţia dintre răspunderea disciplinară şi morală a magistratului

Abstract

Principiul democratic afirmă că nu există putere fără responsabilitate: în măsura în care creşte importanţa socială şi politică a puterii judecătoreşti, creşte și necesitatea față de magistraţi de a răspunde pentru comportamentul lor profesional. Delimitarea dintre normele de conduită etică şi abaterile disciplinare se realizează prin aprecierea fiecărui comportament în parte, raportate la împrejurările obiective şi subiective care au determinat un asemenea comportament, felul în care a fost afectat prestigiul justiţiei, conduita magistratului înainte şi după eludarea normei etice, normele de convieţuire socială impuse de societate sau o anumită comunitate în care acesta îşi desfăşoară activitatea sau viaţa socială. Democratic principle affirms that power without responsibility does not exist: to the extent that the social and political importance of the judicial power grows, the necessity of judges to answer for their professional behavior grows, too. The delimitation between norms of ethical conduct and disciplinary deviation is made through separately appreciation of each behaviour reported to the objective and subjective environment that has determine such kind of behaviour, the way which the justice prestige was affected, judge’s conduct before and after the elucidation of ethical norm, norms of social cohabitation imposed by the society or some community in which he is carrying his activity or social life.
