EVOLUȚIA REGLEMENTĂRILOR ÎN DOMENIUL PESCUITULUI, PROTECȚIEI ȘI FOLOSIRII RESURSELOR BIOLOGICE ACVATICE NATURALE

Abstract

Măsurile de reglementare a pescuitului în Republica Moldova care s-au aplicat de-a lungul anilor în ecosist mele naturale nu au fost întotdeauna eficiente fie prin organizarea defectuoasă a exploatării resurselor piscicole, nerespectarea regimului de pescuit, neevaluarea stării resurselor piscicole, ineficacitatea măsurilor ameliorativ- piscicole ș.a., sau prin imperfecțiunea cadrului normativ. În lucrarea de față în premieră se face o analiză a actelor normative existente în domeniul protecției resurselor biologice acvatice din Republica Moldova în aspect istoric și de conținut. De asemenea, s-a încercat integrarea armonioasă a rezultatelor științifice din domeniul ihtiologiei în cel al dreptului mediului. În urma abordării multisistemice al cadrului normativ existent în domeniul exploatării și protecției resurse lor biologice acvatice s-au înaintat recomandări și propuneri argumentate din punct de vedere științific pentru îmbunătățirea legislației în domeniu.

The fishing regulatory measures that have been applied over the years in the Republic of Moldova in natural ecosystems have not always been effective - either through the faulty organization of the exploitation of fish resources, non-compliance with the fishing regime, failure to assess the state of fish resources, the ineffectiveness of ameliorative measures etc., or through the imperfection of the normative framework. In this paper, for the first time, an analysis of the existing normative acts in the field of protection of aquatic biological resources in the Republic of Moldova is made in historical and content terms. Also, an attempt was made to harmoniously integrate the scientific results from the field of ichthyology into that of environmental law. Following the multi-systemic approach of the existing normative framework in the field of exploitation and protection of aquatic biological resources, scientifically argued recommendations and proposals were submitted to improve the legislation in the field.
