Abstract
Настоящая статья анализирует коллизионные аспекты, касающиеся условий формы сделки на основании статьи 1609 Гражданского кодекса Республики Молдова (книга V- «международное частное право»). Требования к форме сделки устанавливаются законом государства, определяющим существо сделки. Сделка, совершенная за пределами Республики Молдова, считается действительной с точки зрения формы, если она соответствует одному из следующих условий: a) соблюден закон места, где она совершена; b) соблюдены требования законодательства Республики Молдова; c) соблюден национальный закон или закон места жительства совершившего ее лица; d) она является действительной в соответствии с законом, применяемым к органу, рассматривающему ее действительность. Составление, изменение или отмена завещания считаются действительными, если актом соблюдены требования к форме, применяемые в момент его совершения, изменения или отмены либо в момент смерти наследодателя, согласно одному из следующих законов: a) национальному закону наследодателя; b) закону места жительства наследодателя; c) закону места совершения, изменения или отмены акта; d) закону места нахождения недвижимости, являющейся предметом наследования по завещанию; e) закону судебной инстанции или органа, осуществляющего процедуру передачи наследственного имущества.
The paper presents conflict of laws aspects regarding the formal validity conditions of the juridical act reflected in the legislation of the Republic of Moldova and in the speciality literature, starting from the dispositions of art. 1609 of the Moldavian Civil Code (the V-th Book – „International private law”). The formal validity conditions of the juridical act are established by the law of the country that governs the material conditions of the juridical act. The juridical act signed outside the Moldavian borders is considered to be formally valid if it fulfills one of the following conditions: a) the law of the country where the contract was signed; b) the requirements of the Moldavian law are complied with; c) the national law or the domicile law of the person that signed it; d) is valid according to the law applicable to the authority that examines the validity of the juridical act. The signing, the modification or the revoking of the will are considered to be valid if the juridical act fullfils the formal validity conditions applicable at the moment when it was signed, modified or revoked, or at the decease date of the testator, according to one of the following laws: - the national law of the testator; - the domicile law of the testator; - the law of the country where the will was signed, modified or revoked; - the law of the place where the testament immovables are situated; - the law of the court of justice or of the body that fulfills the transfer procedure of the inheritance.
