Abstract

Articolul de faţă este consacrat analizei juridico-penale a infracţiunilor prevăzute la art. 333 „Luarea de mită şi la art.334 „Darea de mită” din Codul penal. Analiza este făcută prin prisma legilor nr.78/2012 şi nr.38/2013. Atenţie prioritară se acordă luării de mită de către un participant la un eveniment sportiv sau la un eveniment de pariat, precum şi dării de mită unui participant la un eveniment sportiv sau la un eveniment de pariat.În acest scop, au fost supuse investigării: obiectul juridic special; obiectul material sau imaterial; victima; conţinutul faptei prejudiciabile; momentul de consumare a infracţiunii; forma şi tipul vinovăţiei; motivul şi scopul infracţiunii; condiţiile generale şi speciale ale subiectului infracţiunii; circumstanţele agravante. Nu în ultimul rând, este analizată relaţia dintre art.2421„Manipularea unui eveniment” din Codul penal şi art.334 CP RM. This article is devoted to the juridical-penal analysis oft he offences referred to at art.333 "The taking of bribe and art.334 "The giving of bribe" from the Penal Code. The analysis is performed considering the adoption of Law nr.78/2012 and Lawnr.38/2013. Priority attention is given to the taking of bribe by a participant in a sporteventor a betting event, as well as to the giving of bribe to a participant in a sport eventor a betting event. To this end, have under gone nvesti-gation the special juridical object , the material or immaterial object, the victim , the content of the prejudicial act , the moment of the offence consumption, the form and type of the guilt , the reason and purpose of the offence , the general and special conditions of the subject of the offence , the aggravating circumstances. Finally yet importantly , there is analyzed the relationship between art.242 1 " The manipulation of an event" from the Penal Code and art.334 PC RM.
