NECESITATEA UNEI PROTECȚII PENALE MAI EFICIENTE ÎMPOTRIVA VÂNATULUI ILEGAL AL ANIMALELOR SĂLBATICE DIN SPECIILE CARE SUNT PE CALE DE DISPARIȚIE

Abstract

În art.233 din Codul penal al Republicii Moldova nu este luat în calcul pericolul social sporit al faptei de vânat ilegal, săvârșite asupra animalelor sălbatice, specificate în Cartea Roşie a Republicii Moldova sau în Convenţia privind comerţul internaţional cu specii sălbatice de faună şi floră pe cale de dispariţie (CITES). În vederea perfecționării legislației, sunt propuse anumite amendamente. Între altele, se propune incriminarea faptelor de: vânat ilegal al animalelor incluse în Cartea Roşie a Republicii Moldova sau în anexele la Convenţia privind comerţul internaţional cu specii sălbatice de faună şi floră pe cale de dispariţie (CITES); vânzare, schimb, oferire spre schimb sau vânzare, deținere, transportare ori expediere a animalelor vii sau moarte incluse în Cartea Roşie a Republicii Moldova sau în anexele la Convenţia privind comerţul internaţional cu specii sălbatice de faună şi floră pe cale de dispariţie (CITES), a părţilor sau derivatelor acestor animale, cunoscând că aceste animale au fost dobândite prin vânat ilegal.In art.233 of the Criminal Code of the Republic of Moldova, the increased social danger of the act of illegal hunting, committed on wild animals, specified in the Red Book of the Republic of Moldova or in the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) is not taken into account. In order to improve the legislation, certain amendments are proposed. Among others, it is proposed to criminalize the acts of: illegal hunting of animals included in the Red Book of the Republic of Moldova or in the annexes to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES); sale, exchange, offer for exchange or sale, possession, transport or dispatch of live or dead animals included in the Red Book of the Republic of Moldova or in the annexes to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), of the parts or derivatives of these animals, knowing that these animals were acquired through illegal hunting.
