INFRACȚIUNEA DE ORGANIZARE A MIGRAȚIEI ILEGALE: LATURA OBIECTIVĂ A INFRACȚIUNII

Abstract

În prezentul articol sunt elucidate modalitățile faptice de săvârșire a infracțiunii de organizare a migrației ilegale. Articolul prezintă o ilustrare a circumstanțelor în care fapta prejudiciabilă a infracțiunii examinate se diferențiază de alte fapte penale conexe. S-a constatat ca organizarea infracțiunii trebuie sa fie săvârșită de autor şi nu de complice. Modalitățile faptice de intrare, ieșire, ședere sau de tranzitare a teritoriului Republicii Moldova sunt examinate sub aspect comparat, luându-se în calcul și legislația Uniunii Europene și a altor state, care reglementează acțiunile prejudiciabile similare. În articol se încearcă a raporta mecanismul răspunderii penale a făptuitorului la standardele internaționale la care Republica Moldova este parte.This article elucidates the factual ways of committing the crime of organisation of illegal migration. The article provides an illustration of the circumstances in which the prejudicial act of the offense under examination differs from other related criminal acts. It was found that the organisation of the crime must be committed by the perpetrator, and not by the accomplice. The factual modalities of entry, exit, stay or transit of the territory of the Republic of Moldova is examined in a comparative aspect, considering the legislation of the European Union and other states, which regulate similar prejudicial actions. The article tries to relate the mechanism of criminal liability of the perpetrator to the international standards to which the Republic of Moldova is a party.
