Contractele-cadru în sistemul asigurărilor obligatorii de asistență medicală: scurt istoric al parcursului regulatoriu

Abstract

On February 27, 1998, the adoption of Law No.1585 on Compulsory Health Care Insurance provided the legal foundation for implementing a new healthcare access system – the compulsory health care insurance system for the country’s population. Participants in the legal relationships of mandatory medical assistance insurance could use (or were obligated to use, as the case may be) the most significant legal instruments for accessing these services – the framework contracts within the respective insurance system. Over a span of 25 years, the legislator established four such instruments: the compulsory medical assistance insurance contract (2002- 2008), the contract for the provision of medical services within the framework of compulsory medical assistance insurance (2002 – present), the contract for the release of medicines and/or medical devices compensated from mandatory healthcare insurance funds (2020 – present), and the contract for the delivery of medicines and/or medical devices compensated to pharmaceutical service providers (2021 – present).
