INVESTIGAŢII HERMENEUTICE ÎN REPUBLICA MOLDOVA ŞI ÎN ROMÂNIA

Abstract

Prezentul studiu este consacrat analizei evolutive a cercetărilor privind interpretarea dreptului prin prisma hermeneuticii în spaţiul Republicii Moldova şi în cel al României. Starea actuală a investigaţiilor hermeneutice în Republica Moldova şi în România este determinată de posibila nedorinţă de a explora un domeniu nou prea sofisticat sau, totuşi, de inutilitatea metodei propuse. Astfel, interpretarea dreptului este abordată ca proces, autorii evidenţiind în mod special metodele şi procedeele de interpretare, fără a fi pe larg elucidate natura, esenţa interpretării, rolul şi semnificaţia ei pentru doctrină şi practică.

This study is devoted to analysis of research on the evolutionary interpretation of the law through the hermeneutics space in the Republic of Moldova and in Romania. The current status of the hermeneutical investigations in Moldova and Romania is due to the potential reluctance to explore a new area or too sophisticated, however, the futility of the proposed method. The interpretation of the law is approached as a process, in particular highlighting the authors methods and processes of interpretation, without extensively elucidated the nature, substance interpretation of the role and its significance to the doctrine and practice.
