Abstract
Demisia reprezintă încetarea contractului individual de muncă din iniţiativa salariatului. O asemenea decizie poate fi luată de salariat dintr-o varietate de motive: începând cu criza economică şi până la performanţele scăzute ale salariatului. Realizarea demisiei cu respectarea termenului de preaviz este legală, iar demisia fără respectarea termenului legal de preaviz are caracte rilegal. Articolul de faţă descrie: ce este demisia, care sunt duratele termenelor de preaviz, precum şi care sunt efectele pe care le produce demisia.
Dismissal is termination of the contract of employment of an employee by his or her employer in a correct, fair and lawful manner. Though such a decision can be made by an employer for a variety of reasons, ranging from an economic downturn to performance-related problems on the part of the employee, being fired has a strongstigma in many cultures. A dismissal with the appropriate notice is a contractually lawful dismissal. A dismissal without the appropriate notice is a wrongful dismissal.
