CONSTATĂRI DE LEGE LATA PRIVIND PROZELITISMUL ABUZIV ŞI EXTREMISMUL RELIGIOS ÎN LEGISLAŢIA EXTRAPENALĂ A REPUBLICII MOLDOVA

Abstract

Analiza problemei conturate în acest articol include: clarificarea noţiunii de religie; recunoaşterea postulatului ştiinţific conform căruia religia constituie pretextul şi nu cauza războaielor; analiza detaliată a legislaţiei extrapenale ce reglementează rapoarte în domeniul religiei. Autorul propune în uz ştiinţific (atât în sfera ilicitului penal, cât şi pentru ştiinţa criminologică) două definiţii proprii: a prozelitismului abuziv şi a extremismului religios.This article is dedicated to several findings de lege lata concerning the abusive proselytism and religious extremism in the extra-penal legislation of the Republic of Moldova. Namely the analysis of the defined problem has been originated from the clarification of the notion of religion; recognition of the scientific postulation that religion constitutes a pretext and not the cause of the war conflicts; the detailed analysis of the extra-penal legislation which regulates the relationships in the domain of religion. The author has proposed for a scientific use for the penal sphere as well as for criminological science two original definitions of the abusive proselytism and religious extremism.
