CONȚINUTUL VINOVĂȚIEI ÎN CAZUL INFRACȚIUNILOR PREVĂZUTE LA art.264 DIN CODUL PENAL

Abstract

Pentru a fi considerată infracțiune, fapta prejudiciabilă prevăzută de legea penală trebuie să fie săvârșită cu vinovăție. Altfel spus, făptuitorul poate fi tras la răspundere penală doar pentru fapta prejudiciabilă și urmările prejudiciabile în privința cărora a fost stabilită vinovăția lui. În art.264 CP RM este specificată imprudența față de urmările prejudiciabile exprimate în vătămarea medie a integrităţii corporale sau a sănătăţii. În același timp, lipsește orice mențiune cu privire la atitudinea făptuitorului față de fapta prejudiciabilă prevăzută la art.264 CP RM – încălcarea regulilor de securitate a circulaţiei sau de exploatare a mijloacelor de transport. Articolul 19 CP RM nu caracterizează conținutul vinovăției în cazul infracțiunilor prevăzute la art.264 CP RM. În esență, infracțiunile prevăzute la art.264 CP RM trebuie considerate infracțiuni săvârșite din imprudență. Săvârșirea de către aceeași persoană (aceleași persoane), în același timp, a faptelor prevăzute la art.228, 235-244 din Codul contravențional și a faptelor prevăzute la art.149 sau la art.157 CP RM are ca efect însumarea pericolului social al acestor fapte și „fuzionarea” lor într-un produs calitativ nou, și anume – în infracțiunile prevăzute la art.264 CP RM. În cazul infracțiunilor prevăzute la art.264 CP RM, conținutul vinovăției include intenția sau imprudența față de fapta prejudiciabilă și doar imprudența față de urmările prejudiciabile.

In order to consider the prejudicial act an offence, within the context of penal law, it must be committed with guilt. In other words, the perpetrator may be held criminally liable only for the prejudicial act and the prejudicial consequences for which his/her guilt has been established. Article 264 PC RM includes the act of recklessness with regard to the prejudicial consequences of middle battery or middle health injury. At the same time, no mention is made regarding the perpetrator's attitude towards the prejudicial act provided by art.264 PC RM – the violation of traffic safety rules or the use of transport rules. Article 19 PC RM does not make any references to the content of the guilt considering the offences set out in art.264 PC RM. In essence, the offences specified in art.264 PC RM should be considered as acts committed by recklessness. The concomitant perpetration by the same person (same people) of the acts stipulated in art.228, art.235-244 of the Contraventional Code and of the acts provided by art.149 or art.157 PC RM generates the combination of the social danger of all these acts and their “merging” into a new qualitative product, namely into the offences provided by art.264 PC RM. With regard to the offences set out in art.264 PC RM, the content of the guilt implies both the intention or recklessness considering the prejudicial act and only the recklessness considering the prejudicial consequences.
