NOŢIUNEA ŞI SEMNELE SUSTRAGERII: ASPECTE TEORETICE ŞI PRACTICE

Abstract

Acest articol este consacrat analizei aspectelor teoretice şi practice ale noţiunii şi semnelor sustragerii. Este formulată definiţia noţiunii de sustragere. În continuare, sunt examinate cele şapte semne constitutive ale noţiunii în cauză: 1) „luarea”; 2) „din posesia altuia”; 3) „a bunurilor mobile”; 4) „ilegală”; 5) „gratuită”; 6) „care a cauzat un prejudiciu patrimonial efectiv acestuia”; 7) „săvârşită în scop de cupiditate”. Examinarea acestor semne se realizează în cadrul analizei elementelor componenţei generice a infracţiunii de sustragere, componenţă ce formează un sistem integral.This article is devoted to the analysis of theoretical and practical aspects of the concept and signs of theft. As a result, it is formulated the definition of theft. There are also cons idered the seven constituent signs of the concept in question: 1) "taking"; 2) "from the possession of another"; 3) "of movable property"; 4) "illegal"; 5) "free of charge"; 6) "that caused a real patrimonial prejudice to its owner"; 7) "committed with the intention of cupidity". The examination of these signs is performed during the analysis of the elements of generic composition of the offense of theft, composition that form a system of a whole.
