CONTRACTUL ÎN FOLOSUL UNUI TERȚ. ASPECTE DEFINITORII DUPĂ MODERNIZAREA CODULUI CIVIL AL REPUBLICII MOLDOVA

Abstract

Contractul în folosul unui terț este acea construcție juridică atipică și absolut impresionantă ce și-a croit din greu locul în cadrul legislațiilor multor state. Reglementarea acestui tip de contract a fost catalizată de necesitatea practică generată de jurisprudență. Prezenta lucrare reprezintă o sinteză exemplară a dimensiunii doctrinar-teoretice a problematicii contractului în folosul unui terț după modernizarea Codului Civil al Republicii Moldova. La fel, sunt abordate și aspectele practice ale contractului în folosul unui terț, iar un aspect deosebit de important este analiza subiectului abordat în lumina noilor reglementări ale Codului Civil al Republicii Moldova.The contract for the benefit of a third person is that atypical and absolutely impressive legal construction that has struggled to make its place in the laws of many states. The regulation of this type of contract was catalyzed by the practical necessity generated by the jurisprudence. This study represents an exemplary synthesis of the doctrinal-theoretical dimension of the contract issue for the benefit of a third person after the modernization of the Civil Code of the Republic of Moldova. The practical aspects of the contract for the benefit of a third person are also approached, and a particularly important aspect is the analysis of the subject approached in the light of the new regulations of the Civil Code of the Republic of Moldova.Le contrat au profit d’un tiers est cette construction juridique atypique et absolument impressionnante qui a eu du mal à faire sa place dans les lois de nombreux États. La réglementation de ce type de contrat a été catalysée par la nécessité pratique engendrée par la jurisprudence. Cet article est une synthèse exemplaire de la dimension doctrinale-théorique de la question du contrat au profit d’un tiers après la modernisation du Code civil de la République de Moldova. Les aspects pratiques du contrat au profit d’un tiers sont également abordés, et un aspect particulièrement important est l’analyse du sujet abordé à la lumière des nouvelles dispositions du Code civil de la République de Moldova.Договор в пользу третьего лица - нетипичная и абсолютно впечатляющая юридическая конструкция, которая трудно обрело свое место в законах многих государств. Регулирование такого типа контрактов было обусловлено практической необходимостью, порожденной юриспруденцией. Данная статья представляет собой примерный синтез доктринально-теоретического измерения вопроса о договоре в пользу третьего лица после модернизации Гражданского кодекса Республики Молдова. Также рассматриваются практические аспекты договора в пользу третьего лица, и особенно важным аспектом является анализ предмета, рассматриваемого в свете новых положений Гражданского кодекса Республики Молдова.
