EFECTUL OBLIGATORIU AL TRATATELOR INTERNAȚIONALE ȘI LIMITELE ACESTUIA

Abstract

În prezenta lucrare ne-am propus drept scop să elucidăm nu doar importanța principiului obligativității tratatelor internaționale, ci și a excepțiilor de la aplicarea aestuia. Astfel, printr-o analiză cuprinzătoare a doctrinei, a prevederilor de tratate și a practiții Curții Permanente de Arbitraj și a Curții Internaționale de Justiție, am reușit să stabilim cu exactitate limitele exercitării forței juridice a principiului pacta sunt servanda și să elucidăm caracterul relativ al acestuia.The scientific paper aims to present not only the importance of the principle that states should fulfil in good faith the obligations assumed by them in the treaties, but also exceptions from the above-mentioned principle. Thus, through the comprehensive analysis of the legal literature, the provisions of treaties and the practice of the Permanent Court of Arbitration and the International Court of Justice, it was possible to establish precisely the limits of the legal force of the pacta sunt servanta principle and to prove its relative character
