INFRACŢIUNEA ÎN NOUA LEGISLAŢIE PENALĂ A ROMÂNIEI

Abstract

Noul Cod penal reprezintă un pas important pentru legislaţia penală a României. Prin prevederile sale legiuitorul a încercat să modifice structura infracţiunii, renunţând la forma tradiţională prevăzută de Codul penal din 1968. Această nouă definiţie este una inovativă şi modernă, în concordanţă cu legislaţia penală europeană prin însăşi modificarea structurii acesteia.The new Romanian Penal Code is a very important step in Romanian criminal legislation. With its provisions, the Romanian legislator attempted to change the design, abandoning traditional solutions contained in the Criminal Code of 1968.The new definition of the offense, although it was wanted to be one innovative and modern, in accordance to criminal laws of other European countries by changing the design of its structure.
