GARANȚIILE PROCESUALE ALE DREPTURILOR VICTIMEI INFRACȚIUNII

Abstract

Săvârșirea unei infracțiuni duce nemijlocit la nașterea unui raport juridic de drept penal substanțial. Constituirea raportului în cauză solicită apariția necesității pedepsirii persoanei responsabile de săvârșirea faptei penale și obligația acesteia de a suporta urmările prejudiciabile ale infracțiunii. Or, procesul penal are ca scop protejarea persoanei, a societății și statului de infracțiuni și orice persoană care a săvârșit o infracțiune trebuie să fie pedepsită potrivit vinovăției sale. În legătură cu necesitatea apărării drepturilor fundamentale, protecția drepturilor victimelor în cadrul procesului penal a devenit una dintre cele mai importante preocupări. Prezentul studiu pune în evidență, o dată în plus, că declanșarea procesului penal, depinde de persoana prejudiciată prin faptele infracționale ale persoanei responsabile de săvârșirea infracțiunii, acest fapt datorându-se interesului victimei de a sesiza organele de drept despre săvârșirea infracțiunii, dorința de a pedepsi infractorul, precum și de a obține repararea prejudiciul cauzat prin infracțiune.

Committing a crime directly leads to the appearance of a substantial criminal law report. The establishment of the report in the cases requires the appearance of the need to punish the person responsible for committing the criminal acts and the obligation to bear the prejudicial consequences of the crimes. Or, the criminal process aims at protecting the persons, the society and the state from crimes and any person who committed or committed the crime must be punished according to his guilt. With regard to the need to defend fundamental rights, the protection of victims' rights in criminal proceedings has become one of the most important concerns. The present study highlights, once again, that the initiation of criminal proceedings depends on the person harmed by the criminal acts of the persons responsible for the crime, this fact being due to the victim's interest to notify the law enforcement about the crime, the desire to -and do. punish the offense as well as to obtain reparation for the damage caused by the offense.
