Abstract
Both doctrine and administrative practice unanimously accepted the theory that
civil servants should be selected exclusively on the basis of competence (the so-called
merit system) at which the contest is based. The contest is carried out in order to attract
the candidates to the public authority to fill the vacant public office and to select from
among them the most suitable candidate. The occupation of the public office vacant
by contest is regulated by the Law on public office and the status of public official no.
158-XIV of 04.07.2008 and the Regulation on the occupation of public office by contest
(amended by Government Decision no.647 of 28.08.2013).
