ÎNSEMNĂTATEA ELEMENTULUI EMOTIV ÎN STRUCTURA TRIPARTITĂ A VINOVĂŢIEI ÎN DREPTUL PENAL SUBSTANŢIAL

Abstract

În prezentul articol sunt supuse unei analize minuţioase noţiunea şi structura vinovăţiei în dreptul penal substanţial. Prin argumente de rigoare s-a demonstrat că vinovăţia are o structură tripartită (elementele intelectiv, volitiv şi emotiv). Folosind diverse metode ştiinţifice autorul prezintă o nouă abordare a vinovăţiei, ceea ce i-a permis să fundamenteze un concept original cu privire la particularităţile atitudinii psihice manifestate atât de către persoanele care au comis fapte prejudiciabile cu discernământ păstrat, cât şi de către persoanele cu discernământ diminuat. Este subliniată semnificaţia juridico-penală a emoţiilor sub imperiul cărora sunt comise fapte infracţionale, demonstrând că în unele cazuri stările emotive deosebite pot influenţa diminuativ psihicul uman. Întru confirmarea propriei poziţii, autorul a purces la o abordare multidisciplinară(drept penal, psihologie, neurofiziologie) a obiectului de cercetare. Pe cale de consecinţă, s-a constatat existenţa unei lacune legislative depistate în art.231 CP RM, care poate fi înlăturată doar prin extinderea temeiurilor de operare a normei cu privire la responsabilitatearedusă.

In this article there are subject to a detailed analysis the notion and the structure of culpability in the Substantive Criminal Law. By means of important arguments there was demonstrated that culpability has a tripartite structure (the intellectual, volitional and emotional element). Applying different scientific methods, the author has performed a new approach of culpability that has contributed to the creation of a new original concept regarding the peculiarities of mental attitude manifested by the persons with full discernment both by those who had committed crimes with diminished discernment. The author has emphasized the significance of the emotions in Substantive Criminal Law, proving that in some cases the special emotional state of the perpetrator could have a diminutive influence upon the human mind. In order to confirm proper position, the author effectuated a multidisciplinary scientific approach (criminal law, psychologyand neurophysiology). As a result, there was detected a legislative deficiency in the limits of the article 231 Criminal code of the Republic of Moldova, which could be eliminated, according to the view of the author, only in the case if the legal norm on diminished responsibility will be revised for further extension of the legal grounds of its operation.
