SUBDEZVOLTAREA PSIHICĂ –CAUZĂ CARE EXCLUDE SAU DIMINUEAZĂ RESPONSABILITATEA PERSOANEI FIZICE ÎN DREPTUL PENAL

Abstract

În acest articol este examinată problema ce vizează subdezvoltarea psihică a făptuitorului, privită sub aspectul cauzelor care exclud sau diminuează responsabilitatea persoanei fizice în dreptul penal. Pentru a da răspunsuri clare şi exhaustive, autorul a purces la analiza detaliată a doctrinei juridico-penale, precum şi a psihiatriei, în urma căreia au fost date definiţiile noţiunilorde discernământ şi de responsabilitate, a fost formulat şi propus spre utilizare un nou concept de subdezvoltare psihică. Autorul a demonstrat necesitatea revizuirii normei juridico-penale cu privire la iresponsabilitate şi responsabilitate redusă prin introducerea în textul legii penale a sintagmei „retard mintal”. În cadrul prezentului mesaj ştiinţific sunt explicate efectele juridice ale varietăţilor de aplicare a normei cu privire la responsabilitatea redusă faţă de minori care au comis fapte prejudiciabile.In this article there are subject to a detailed examination the problem of mental immaturity of the offender regardedas a form of general or partial psychiatric defences in Criminal Law. In order to respond on these questions the author has effectuated a detailed analysis of the penal doctrine and psychiatry and as a result of such approach has formulated the notions of “discernment” and “responsibility”, there were formulated and proposed for the further implementation a new concept of mental immaturity. The author demonstrated the necessity of legislative revision of the norms of irresponsibility and diminished responsibility by means of introduction of a new legislative expression of “mental retardation”. In the frame work of this scientific research there were explained the legal effects of different variations of the legal norm regarding the diminished responsibility of the minors who had committed criminal misdeeds.
