ASPECTE DE DREPT INTERNAȚIONAL IN CONTEXTUL CONFLICTELOR INGHEȚATE: CAZUL TRANSNISTRIEI

Abstract

The subject of applicable jurisdiction in relation to members of the armed forces of the Russian Federation stationed on the territory of the Republic of Moldova is under the agenda of public international law.Given that the principle of sovereign equality of states is one of the fundamental principles in public international law, each state retains the right to exercise its jurisdiction in relation to persons and property located in or outside the contry. Under these conditions, a single solution cannot exist, as such situations are governed by international agreements, including bilateral and multilateral ones. Intarnational agreements may provide for the application of state jurisdiction under certain conditions, the requirements for the surrender and extradition of persons, the esteblishment of Commissions of Inquiry or Conciliation for the purpose of setting conflict situations, etc.
