STAREA, STRUCTURA ŞI DINAMICA INFRACŢIUNILOR DE PORNOGRAFIE INFANTILĂ

Abstract

Prin pornografie infantilă, conform Codului penal al SUA, se înţelege orice reprezentare vizuală reală sau generatăde calculator ... ce exprimă un comportament sexual explicit ... În vederea dimensionării în plan legislativ şi practic a fenomenului pornografie infantil ă, prezentul articol procesează starea, structuraşi dinamica infracţiunilor de pornografie infantilă prin examinarea unor cazuri de referinţă la nivel internaţional. Prin urmare, e tratat cazul Statelor Unite ale Americii, stat cu cel mai mare şi cuprinzător arsenal legislativ împotriva pornografiei infantile. Congresul american a încercat să armonizeze legile privind pornografia infantilă erei digitale. E valorificat cazul Angliei şi Walesului, unde are loc individualizarea pedepsei şi diferenţierea sancţiunilor pentru pornografia infantilă, ţinându-se cont de doi factori: natura materialelor indecente şi nivelul implicării infractorului în fapta ilicită. Legiuitorul englez a prevăzut şi circumstanţe agravante pentru: demonstrarea sau distribuirea materialelor unui copil; numărul imaginilor impun ător de mare; utilizarea materialelor în scop comercial; publicarea lor în reţeaua Internet. În continuare sunt stabilite realităţile pornografiei infantile şi analizate cazurile Federației Ruse şi Republicii Moldova. În final sunt propuse recomandări importante în vederea prevenirii, combaterii şi reducerii fenomenului pornografie infantilă la nivel local şi global.

Child pornography, according to the U.S. Penal Code, means any visual representation ... real or computer generated expressing sexually explicit conduct ... In order to size legislatively and practical the phenomenon of child pornography, this article is processing the state, structure and dynamics of child pornography offences by examining relevant international cases. Therefore, there is treated the case of the United States, the country with the largest and comprehensive legal arsenal against child pornography. The U.S. congress was the first to attempt to harmonize laws on child pornography to the digital age. In addition, there are cons idered the cases of England and Wales, where first occurred the individualization of the punishment and differentiation of sanctions for child pornography offences, taking into account two factors: the nature of the indecent material and the level of involvement of the offender. The English legislature provided and aggra- vating circumstances for: the demonstration or distribution of the material to children; the large number of images; the use of the material for commercial reasons; the publishing of the material on the Internet. Further are established the realms of child pornography and analyzed the cases of the Russian Federation and the Republic of Moldova. Finally, but not least there are proposed important recommendations to prevent, combat and reduce the phenomenon of child pornography on local and global levels.
