ANALIZA MODIFICĂRILOR ÎN EXECUTAREA OBLIGAȚIILOR PECUNIARE, INTRODUSE ÎN CODUL CIVIL AL REPUBLICII MOLDOVA

Abstract

Prezentul articol analizează principalele modificări cu privire la executarea obligațiilor pecuniare care au fost introduse în cadrul reformei de modificare a Codului Civil al Republicii Moldova (în vigoare de la 1 martie 2019). În cadrul reformei au fost utilizate mai multe instrumente europene și internaționale cu reguli-model din domeniul dreptului privat, cu accent pe DCFR (Draft Common Frame of Reference) și Principiile UNIDROIT, fapt care a influențat și textul unor articole privind executarea obligațiilor pecuniare. În acest context, în articol este prezentată o viziune comparativă a modificărilor implementate în cadrul legal național și instrumentele model din care au fost inspirate și examinate unele problematici practice de aplicare a acelor prevederi.

The article examines the main amendments on performance of the monetary obligations that have been introduced as part of the reform on amending the Civil Code of the Republic of Moldova enacted as from 1 March 2019. As part of the reform there were used more European and international instruments with model rules from the field of private law, with accent on DCFR and UNIDROIT Principles, the fact that influenced also the text of certain articles on performance of the monetary obligations. In this context, in the present article is presented a comparative view of the implemented amendments in national legal framework and the model instruments that served as source of inspiration and are examined some practical problematics on applying those provisions.

L’article examine les principaux amendements sur l’exécution des obligations monétaires qui ont été introduits dans le cadre de la réforme sur l’amendement du Code Civil de la République de Moldavie entré en vigueur a partir du 1er mars 2019. Dans le cadre de la réforme, on a utilisé davantage d’instruments européens et internationaux avec des règles modèles du domaine du droit privé, en mettant l’accent sur les principes DCFR et UNIDROIT, ce qui a également influencé le texte de certains articles sur l’exécution des obligations monétaires. Dans ce contexte, le présent article présente une vue comparative des modifications apportées aux cadres juridiques nationaux et des instruments types qui ont servi de source d’inspiration et examine certaines problématiques pratiques relatives à l’application de ces dispositions.

В данной статье рассматриваются основные изменения по выполнению денежных обязательств, которые были внесены в рамках реформы в Гражданский Kодекс Республики Молдова, вступивший в силу с 1 марта 2019 года. При проведении реформы были использованы разные европейские и международные инструменты с типовыми нормами в области частного права, с акцентом на DCFR (общая система координат европейского частного права) и принципы UNIDROIT (Международный институт по унификации частного права), что повлияло и на текст некоторых статей об исполнении денежных обязательств. В данном контексте, в статье представлен сравнительный взгляд на внесенные в национальное законодательство и типовые документы, изменения которые послужили источником вдохновения, и рассматриваются некоторые практические проблемы, связанные с применением этих положений.
