ANALIZĂ DE DREPT PENAL A INFRACŢIUNILOR PREVĂZUTE LA ART.186 „FURTUL” DIN CODUL PENAL

Abstract

Obiectul prezentei cercetări îl constituie caracteristicile elementelor constitutive (obiectul infracţiunii; latura obiectivă a infracţiunii; latura subiectivă a infracţiunii; subiectul infracţiunii), precum şi ale elementelor circumstanţiale agravante ale infracţiunilor prevăzute la art.186 CP RM. De asemenea, se explică de ce art.186 CP RM stabileşte răspunderea pentru patru infracţiuni de sine stătătoare (şi nu pentru una singură, aşa cum s-a considerat până acum): nu există o componenţă „de bază” de furt care ar consta în sustragerea pe ascuns a bunurilor altei persoane, componenţă care: 1) nu ar presupune producerea unui prejudiciu patrimonial efectiv având o mărime concretă şi 2) pe care s-ar grefa în calitate de circumstanţe agravante: a) producerea unui prejudiciu patrimonial efectiv în proporţii mici; b) producerea unui prejudiciu patrimonial efectiv a cărui mărime este între limitele de 25-2500 unităţi convenţionale; c) producerea unui prejudiciu patrimonial efectiv în proporţii considerabile); d) producerea unui prejudiciu patrimonial efectiv în proporţii mari; e) producerea unui prejudiciu patrimonial efectiv în proporţii deosebit de mari

The object of this research is the characteristics of the constituent elements ( the object of the offence; the objective side of the offence ; the subjective side of the offence; the subject of the offence) , as well as the characteristic s of the aggravating circumstantial elements of the offenses referred to art.186 PC RM . It is also explained why art.186 PC RM establishes the liability for four independent offences ( not only for one as it was considered up till now ): there is no " fundame ntal" theft part that would consist in hidden circumvention of property of another person, part that: 1) does not require the production of an effective patrimonial damage with a specific size and 2) you could graft as aggravating circumstances: a) the pro duction of an effective patrimonial damage in small proportions ; b ) the production of an effective patrimonial damage whose size is within the range of 25 - 2500 conventional units ; c) the production of an effective patrimonial damage of considerable proport ions ; d) the production of an effective patrimonial damage of large proportions; e ) the production of an effective patrimonial damage of extremely large proportions .
