INSTITUȚIA CĂSĂTORIEI ȘI RELAȚIILE DE RUDENIE ÎN ȚARA MOLDOVEI (SEC. AL XVII-LEA ‒ ÎNCEPUTUL SEC. AL XIX-LEA)

Abstract

Scopul tezei: analiza complexă, interdisciplinară a instituției căsătoriei și relațiilor de rudenie din Ţara Moldovei (ca produs al acestei instituții) în sec. al XVII-lea ‒ începutul sec.al XIX-lea, cu componentele sale legislativ-canonice, cu etapele sale caracteristice, dar și ca fenomen social.

Цель диссертации: комплексный междисциплинарный анализ института брака и родственных отношений в Молдавском княжестве в XVII – начале XIX в. применительно только к румынским православным, с его законодательно-каноническими составляющими, с характерными для него этапами, а также рассмотрение его как общественного явления. Задачи диссертации отражают анализ историографии и исследование источников; обеспечение широкого представления об институте брачно-родственных отношений путем выделения характерных элементов социального института и его воздействий, установления степени родства, представления конкретных ситуаций; исследование отношения церкви, элиты или общества к законным и незаконным бракам; определение запретов и их применимости; анализ участия членов общества в составлении брачного союза; освещение отношений при духовном родстве; анализ случаев заключения второго, третьего и четвертого брака, браков с родственниками, смешанных браков и последствий их заключения; прояснение условий расторжения брака; выявление мотивов развода и повседневной реальности; определение терминов.

The aim of the thesis: the complex, interdisciplinary analysis of the institution of marriage and kinship relations in the Pricipality of Moldova in the 17th century - the beginning of the 19th century, with reference only to the marriage of the Romanian Orthodox, with its legislative-canonical components, with its characteristic stages, but also as a social phenomenon.The objectives of the thesis reflect the analysis of historiography and the research of sources; providing a broad view of the institution of marriage and kinship relations by highlighting the characteristic elements of a social institution, its effects, establishing the degree of kinship, presenting the real situation; researching the attitude of the Church, the elite or the community towards legitimate and illegitimate marriage; determination of prohibitions and their applicability; the analysis of the involvement of the members of the society in the constitution of a matrimonial alliance; elucidation of the relationship of soul kinship; the analysis of the cases of concluding the second, third and fourth marriage, of the marriages with the relatives, of the mixed ones and the effects of their conclusion; elucidating the conditions for the dissolution of the marriage; highlighting the motivations for divorce and the daily reality; identifying the terms.
